Terms of Service
These Terms of Service govern access to and use of MarketFlow AI, including the website at marketflow.ecopowerhub.ai, related subpages (including City Pages and industry pages), the progressive web app, the Android app, APIs, dashboards, and any feature we enable in your workspace. By creating an account, clicking accept, connecting a payment method, connecting a third-party integration, or using the Service, you agree to these Terms. 1. Who we are
MarketFlow AI is operated by EcopowerhubAI LLC. We are the seller of record for paid plans. Customer support and refund decisions are handled by us at support@ecopowerhub.ai. Card processing is performed by Stripe, Inc., not by us storing your full card number.
2. Our Service
MarketFlow AI is an AI marketing studio and local-business growth platform. It helps a business describe itself once and then generate, organize, preview, and (where you connect a channel) publish marketing work. Features depend on your plan, workspace role, region, third-party approvals, and technical availability. Maya is the in-product AI business strategist and marketing companion. The Marketing Studio generates social campaigns for Instagram, Facebook, LinkedIn, TikTok, and X. The Service may generate images, suggest video concepts, and provide templates for local industries. City Pages are marketing and SEO pages for MarketFlow and are not a claim that EcopowerhubAI LLC maintains a staffed office in every city named. SEO Articles and Blog Growth help you generate long-form content; optional CMS publishing requires your authorization. WhatsApp Marketing uses the official WhatsApp Business Platform / Meta Cloud API only, with template-only business-initiated broadcasts, paced sending, and honest status reporting until Meta approval and a connected number exist.
3. Accounts, workspaces, and roles
You must provide accurate account information and keep credentials confidential. Workspaces may have roles such as owner, admin, or editor. Actions taken with your login are treated as your actions. We may require verification, limit free seats, or close abandoned accounts. You are responsible for everyone you invite.
4. Subscriptions, trials, payments, and tax
Paid plans are sold by EcopowerhubAI LLC and payment methods are processed by Stripe. We do not store full Primary Account Numbers on MarketFlow servers. Plans may be monthly or annual and renew automatically until you cancel in the billing portal from your Account page. Free trials and introductory coupons are controlled by the checkout screen; unless you cancel before the trial ends, paid billing starts. Refunds are decided by EcopowerhubAI LLC under our Refund Policy. Applicable VAT/GST/sales tax may be calculated by Stripe Tax at checkout. We may change list prices; changes apply to the next renewal unless law requires otherwise.
5. Fair use, quotas, and rate limits
Plans are for one legitimate business or brand unless an Enterprise agreement says otherwise. Agency-style multi-client factories, white-label resale, or sharing one seat across unrelated companies requires a written Enterprise deal. We apply generation quotas, per-user rate limits, bot checks, and abuse logs. Circumventing limits or attacking the API is a breach and may result in throttling, queuing, or suspension.
6. Directory, listings, and Trusted by
If the Service displays partner names, customer stories, city lists, industry lists, or a business directory, you grant us permission to display your business name, logo, city, and a short description if you opt in. You can ask us to remove a voluntary listing by emailing support@ecopowerhub.ai. You may not submit fake businesses, fake reviews, or scraped competitor listings. Ranking or placement is not a secret pay-to-rank scheme unless we publish an advertising product with that label.
7. Integrations
The Service connects, with your permission, to third parties including Stripe, Meta / WhatsApp Cloud API, WordPress, analytics providers, app stores, email delivery services, webhooks you configure, and Cloudflare or similar edge/CDN services. You authorize the minimum data exchange needed to operate an integration. Each provider's terms apply. If an integration requires secrets, we store them on the server using encryption and access controls and they are not exposed in the browser.
8. Security and transactions
We implement HTTPS, encrypted storage of provider secrets, workspace-scoped database access policies, role checks on sensitive actions, rate limiting, webhook verify-token checks where supported, and signed-in session auth. Payment card data is handled by Stripe. No internet service is perfectly secure. You must use a strong password and tell us promptly at support@ecopowerhub.ai if you believe an account was compromised. You must not probe, scan, or load-test the Service without written permission, use another customer's workspace, or attempt to extract other tenants' data.
9. Content ownership, watermarks, and license
You own the marketing content you generate, subject to these Terms, third-party model and platform terms, rights in material you uploaded, and any attribution or watermark we apply. You grant us a limited license to process your prompts and uploads to provide, secure, and improve the Service. We may add Created with MarketFlow AI or similar marks. You are solely responsible for clearing music, faces, landmarks, competitor trademarks, and advertising claims before you publish.
10. Acceptable use
You may not use the Service for illegal, fraudulent, or deceptive content; IP, publicity, or privacy infringement; pornographic or exploitative material; hate, harassment, or discrimination; spam or unsolicited bulk messages; violations of Meta, Instagram, Facebook, WhatsApp, TikTok, X, LinkedIn, YouTube, Google, Apple, or WordPress rules; malware or phishing; scraping or reselling personal data from the Service or City Pages; training competing foundation models on our outputs; or white-label resale without an Enterprise agreement. WhatsApp users must keep recorded opt-in, use Meta-approved templates for business-initiated sends, reply only inside the 24-hour customer-care window, and honor STOP, UNSUBSCRIBE, and CANCEL immediately.
11. AI-generated content
All Studio copy, Maya answers, articles, images, chatbot replies, and strategy outlines are AI-generated or AI-assisted. We do not warrant accuracy, originality, ranking, deliverability, or fitness. Outputs can be wrong, biased, or similar to existing work. You must review before publish or send. MarketFlow is not a substitute for regulated professional advice.
12. Third-party platforms
Posting to Instagram, Facebook, LinkedIn, TikTok, X, WhatsApp, WordPress, or any other network is your act. If a network rejects a template, bans a page, or changes an API, that is outside our control. App Review can delay or deny a feature. In-product status flags such as In motion describe that honestly.
13. Privacy, retention, and deletion
Personal data is described in the Privacy Policy. Workspace owners and admins may use in-product WhatsApp data deletion where provided, which deletes local WhatsApp rows and removes stored tokens, and attempts to unsubscribe the app from the WABA when a live connection exists. Platform-wide account deletion requests go through /data-deletion and support@ecopowerhub.ai.
14. Intellectual property in the product
We own MarketFlow AI, Maya, Ecopowerhub brands, software, UI, documentation, and default templates. You may not copy the product, scrape the directory to rebuild it, or remove our brand from the app UI in a way that implies you built the underlying platform.
15. Disclaimers
THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uptime, rankings, message delivery, Meta approval, or business results.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECOPOWERHUBAI LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the maximum permitted.
17. Indemnity
You will indemnify and hold harmless EcopowerhubAI LLC and its officers from claims arising out of your content, your WhatsApp lists, your ads, your integrations, or your breach of these Terms or of Meta / platform rules.
18. Suspension and termination
You may stop using the Service and cancel paid plans in the billing portal. We may suspend or terminate access for breach, abuse, legal risk, non-payment, or platform-required reasons including a Meta or Stripe action. Sections that should survive (ownership, liability, arbitration, WhatsApp prohibitions) survive.
19. Arbitration and governing law
Any dispute arising out of these Terms or the Service shall be resolved by binding individual arbitration in Maryland, USA, under the rules of the American Arbitration Association. You and EcopowerhubAI LLC waive jury trial and class actions. These Terms are governed by the laws of the State of Maryland, excluding conflict-of-laws rules. Payment disputes follow Stripe's process. Refund eligibility follows our Refund Policy.
20. Changes
We may update these Terms. The Last updated date will change. Continued use after an update constitutes acceptance. If a change is material to billing or to WhatsApp rules, we may also notify you in-product or by email.
